I own a condo in Mill Run, which is in the Land Use District 30.2. It adjoins Land Use District 24 and Land Use District 30. Let’s review the guidelines for these land use districts.
District 24 is in zone 1 of the short-term rental overlay map. District 30.2 adjoins District 24 and is adjacent to District 30. What are the guidelines for districts?
District 24 Guidelines: District 24 is a wooded area near the base of Peak 9. Existing high-density residential uses have been concentrated in this area, which is within walking distance of the ski lifts and downtown . Acceptable Land Uses: Residential, Multifamily.
District 30.2 Guidelines: District 30.2 is located south of downtown in Warriors Mark. The neighborhood includes high-density townhouse and condominium developments. Acceptable Land Uses: Residential.
Districts 30 and 30.4 also adjoin District 24 and have essentially the same guidelines. In District 30, which is further from the ski area than District 30.2, it is also stated that “District 30 is very compatible with Districts 24 and 29 in terms of land use types and intensities”.
Do you see the similarities here? They are all labeled “residential”, but some are arbitrarily excluded from Zone 1. It means absolutely nothing,
Using the reasoning the overlay committee seems to have used, I don’t understand how they could exclude District 30.2 from Zone 1 and move it up to Zone 3. District 30.2 adjoins District 24 and was basically built up as short term rental accommodation for skiers (because it is so close to the base of peak 9 and the main street and town centre).
